Welcome to Himalayan Agro Trade Link Pvt. Ltd. These Terms & Conditions outline the rules and guidelines governing the use of our website and our agricultural procurement, wholesale trading, import, and export services. By using our website or engaging with our services, you acknowledge and agree to comply with these terms.
1. About Our Services
We are a B2B agricultural trading and procurement company. We source in bulk from village farmers, cooperatives and producers, then aggregate, inspect, store and trade at scale for wholesalers, distributors, retailers, institutional buyers and international buyers. All supply is B2B, Price on Request and subject to MOQ.
2. Quotations & Pricing
All prices are Price on Request and quoted per lot, grade, packaging, quantity and delivery location. Quotations are valid as stated in the quote and subject to availability and quality verification at collection/warehouse. Market prices may change due to seasonality and supply.
3. Orders & Acceptance
Submitting a bulk inquiry is not a confirmed order. An order is confirmed only upon our written acceptance (proforma/invoice) and, where required, advance payment. We may decline or limit orders due to availability, quality or logistics constraints.
4. Quality & Inspection
We follow a process-driven quality system: inspection, moisture, weight, grading, packaging and traceability. While we strive for consistency, natural agricultural variation may occur. Quality disputes must be raised within 48 hours of delivery with evidence.
5. Packaging & MOQ
Standard packaging is 25KG / 50KG / Bulk and custom as agreed. Each product has a Minimum Order Quantity (e.g., Rice 500KG, Cardamom 100KG). MOQ may vary by lot and season.
6. Warehousing & Storage
We provide dry, ventilated warehousing with lot traceability. Storage beyond agreed timelines may incur charges. Risk transfers as per agreed Incoterms/delivery terms.
7. Logistics & Delivery
Domestic and export logistics are arranged as per quotation. Delivery timelines are estimates; delays due to weather, transport or regulatory factors are not our liability. Export documentation, packaging and compliance are handled per shipment.
8. Payment Terms
Payment terms are as per proforma (e.g., advance, part advance, or as agreed). Do not share exact company payment policies in demo — use editable commercial terms. Late payments may incur interest and affect future supply.
9. Cancellation & Returns
Confirmed bulk orders may not be cancellable once aggregation/packaging has started. Returns are not accepted for bulk commodities except for proven quality non-conformance reported within 48 hours. Any approved return is at buyer’s logistics cost.
10. Farmer Procurement
We buy directly from farmers and cooperatives with transparent weighing, grading and receipts. Pricing is linked to market and grade; payment terms are agreed individually per collection. This section does not create employment or partnership beyond trade.
11. Intellectual Property
Our website content, logo, images and text are our intellectual property. You may not copy, reproduce or use them without written permission.
12. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential losses. Our liability is limited to the value of the relevant lot. Force majeure events (natural disasters, regulatory changes, transport disruptions) excuse performance.
13. Governing Law
These terms are governed by the laws of Nepal. Disputes are subject to the jurisdiction of courts in Kathmandu, Nepal, with amicable settlement attempted first.
14. Changes to Terms
We may update these terms to reflect operational or legal changes. We will post the new date and, for material changes, provide notice. Continued use after changes constitutes acceptance.
